Who am I? – A Lenders Worst Nightmare!
I’m just like you! If you either got a new loan or a refinance in the past three years you may have defenses and counterclaims which could offset everything you owe the lender and more. I’m a victim of lender who willfully refinanced me promising non-existent benefits. I was convinced to give up a 5.25% rate locked in for five years with the promise of a 1% interest rate and lower payments. Of course that is not what I got. But what shocked me even more was as I began to investigate all of my loan documents I found so many state and federal laws had been broken it horrified me. 

Many violations are commonplace in most loans. I struggled with finding a lawyer and contacted several before I found one. Most took just a cursory look at my documents and were unwilling to go up against the lender. A few said I would have to pay them up front and I didn’t have the money. Now after all of those meetings, I’m glad I they didn’t agree to represent me. Not one found the $966 overcharge on recordation tax. This was a glaring error on the face of the HUD-1. And these were lawyers who hold themselves out as experts in lender liability. At least as expert as anyone can be at this stage in the game. So if I had relied solely on their expertise, or lack thereof, where would I be? In the course of my problem I spoke with several bankruptcy attorneys and not one of them knew anything about any rights or remedies. To this date I have not spoken to one bankruptcy attorney who knows or is interested in knowing about this issue. Ironic considering how much it could help clients in bankruptcy trying to save their house. This is such a new area everyone is just now learning about it. The laws aren’t new just the enforcement of them. So I went into bankruptcy pro se initially to save my house and then dropped out to pursue the lender through a lawsuit. After meeting with several attorneys I got frustrated and realized I might have to go it alone. So I did three months of research and prepared my own complaint and filed it in Federal Court. Thankfully, shortly after I filed I did find a lawyer. Not just any lawyer but one of the top law firms in the country. Since filing I have also received calls back from three other firms who decided they would like to represent me. Had I waited however I would have lost my one year right of affirmative action for some of my violations and I didn’t want to lose anything. You can file a complaint and then shop for a lawyer. They can amend a complaint after it is filed. But it is important your complaint states good cause and solid facts or a judge can reject it.
Lenders will spend the millions and billions they have stolen over the past several years to fight and most people don’t have the kind of resources to fight back. They counted on that.

So now I have made it my mission to try and help anyone and everyone I can. I’m a single mother and I took care of my father for nine years after he suffered a stroke. I was tired and worn out when this company promised me the moon and I believed them. I believed they really had my best interest at heart. They are liars, and white collar criminals in suits. Make no mistake they knew exactly what they were doing. It is the most sophisticated scam going. They operate sham companies to funnel illegal kickbacks and train their brokers just what to say to coerce you. They create loans with no regard to helping anyone, and sell them off to someone else. I can refer you to the appropriate federal or consumer agency or to an attorney who can help you. Please be very careful of the scam businesses that offer to bail you out. Some want as much as $595 or more up front and offer nothing more then to negotiate a repayment term with your lender and creditors and or manage your finances. Something you can do yourself or with the help of a non-profit agency like ACORN. The problem is if you are like me, you don’t even know what your issues may be or where to start for help. Every group and agency out there for help is overwhelmed right now. For some of you it may require staying under the protection of the bankruptcy court. For others it may be a government program to get you out of a high rate adjustable loan. For most it will include some kind of legal action against a lender.
